Update
MOSSEL BAY NEWS - The Cape Town High Court has granted the body corporate of Gouriqua, an apartment complex adjacent to Big Daddy’s, an urgent interdict against the restaurant.
On the evening of 20 May, Big Daddy’s announced the closure of its 8 Grave Street restaurant from 21 May until further notice.
Gouriqua’s interdict was granted on 19 May, and it orders the restaurant to stop operations at its 8 Grave Street premises at the Eden Office Park until it has taken the necessary steps to install equipment and ensure no noxious fumes or oil particles are emitted from the business, that it complies with by-laws relating to noise nuisance and that it meets the necessary licensing requirements.
The Mossel Bay Municipality had also applied for an interdict against the restaurant in December, stating in its application that the eatery had allegedly been operating for almost a year without a business licence *, that it was in contravention of public nuisance and air quality control by-laws and that the premises deviates substantially from the building plans first submitted by Big Daddy’s. New plans have since been submitted, but have yet to be approved.
The municipality previously told Mossel Bay Advertiser there are currently civil and criminal cases pending, and that it could not comment further as the information was deemed to be privileged and sub judice.
The Gouriqua body corporate had reportedly submitted its own application for the urgent interdict on Tuesday 19 May, the same day it was granted.
The order, a copy of which Mossel Bay Advertiser is in possession, states that Big Daddy’s is interdicted from operating until it complies with by-laws and licensing requirements.
It also orders the restaurant to install equipment that does not institute a noise nuisance, that it secures its gas installation safely and in accordance with by-laws and regulations, and that it erects a firewall in accordance with by-laws and regulations.
The restaurant is prohibited from causing a noise nuisance to the surrounding buildings. The interdict also orders Big Daddy’s to pay the cost of the application.
The director of Big Daddy’s and the Mossel Bay Municipality have been asked for comment. It will be added to this article as soon as it is received.

*This article has been amended. According to court documents that Mossel Bay Advertiser is in possession of, Big Daddy's liquor license for it's Powry Street premises was transferred to its 8 Grave Street premises in October last year.
