MOSSEL BAY NEWS - Judge Lister Nuku ruled that the confession made by Samkumzi Benya is admissible.
Benya is one of the five men accused of the murder of Heila Kilian on a farm outside Still Bay on 16 April 2018.
Kilian, who was visiting her sister Brenda Thomas and brother-in-law David was shot and killed when they were attacked during an evening braai. The Thomas's, their tenant Shaun Vorster and Kilian were tied up and beaten during their two-hour ordeal. The five men are accused of murdering Kilian and stealing R40 000 in cash and several firearms from Vorster.
This morning the court heard evidence from state's witness Xolani Kwinana, who testified that he was the person who drove the five accused from where they lived in Riversdale to just outside Still Bay on the day of the murder.
Kwinana told the court that he got to know the five accused through his neighbour and that they sometimes drank together at various taverns in the Riversdale area. He said that he was approached by suspect number two, Nkosisethu Nocuza, who he knew as Nozulu or John, to drive himself and four others to Still Bay.
Kwinana said that he agreed to do so, but did not have any prior knowledge that the group was intending to commit a crime.
After dropping them off about 15-20km from Still Bay, Kwinana returned home and about a week later began to hear rumours that the five were involved the high-profile murder that shocked the small town.
Brenda and David Thomas are expected to take the stand on Thursday or Friday.
