The department filed court papers opposing an urgent application by Denis Krejcir and his 22-year-old “life partner” Marlene Nezar for an order permitting Denis to return to South Africa pending the finalisation of their challenge to his “exclusion” from the country.
Nezar claimed in court papers Denis was declared a prohibited person and deported.
But Home Affairs said he was never deported, expelled or excluded from South Africa. He was also not being forced to remain in the Czech Republic. He was simply not permitted entry into South Africa, the department said.
The couple were on their way for a holiday abroad with Denis’ brother and mother Katerina Krejcirova in December last year when they were informed that Denis had been classified a prohibited person because his permanent residence permit was “fraudulent”.
Nezar said in court papers they were eventually allowed to leave, but were told Denis would not be allowed to return to South Africa.
