MOSSEL BAY NEWS - The KwaNonqaba police communications officer, Sgt Kapp, says the police are investigating a case of rape after a man raped a woman who said "no" to sex.
The man, purportedly the victim's boyfriend, demanded sex from the woman in their communal home in Endlovini. When she refused him consensual sex, the man allegedly assaulted her and forced himself on her.
"Consent for intercourse needs to be given enthusiastically. Otherwise, it is rape," Sgt Kapp says.
"One of the most critical issues about rape is the question of consent. Sexual activity should not take place unless both parties have freely agreed to have sex, and the consent is clearly understood by both parties.
"Silence does not imply consent. If the consent is given under duress (physical or emotional threats), the act amounts to rape. When consent is not given freely or willingly, the intercourse that follows is rape.
"Someone who is impaired due to alcohol or drugs is deemed incapable of willingly giving consent and sex with that person is rape, even if the impaired person may have said 'yes'."
Sgt Kapp invited victims of sexual abuse and assault to visit the KwaNonqaba Police Victim Empowerment facility for help.
