NATIONAL NEWS - The Cape Town High Court will rule on Patricia de Lille’s urgent application to retain her post as mayor on Tuesday, her legal team said.
Advocate Johan de Waal said the ruling was expected at 1.15pm.
A senior Democratic Alliance (DA) member said the party leadership had therefore delayed plans to fill vacant seats on the mayoral council on Monday afternoon by a day.
De Lille on Friday asked the high court to rule that she be allowed to hold on to the mayoralty until her challenge to the party’s decision to end her membership is heard in mid-June.
She was kicked out of the DA, and thereby removed as mayor after an increasingly fraught seven-year stint in the job, last week. The party used the so-called cessation clause in its constitution, which stipulates that a member ceases to belong to the party once he or she publicly declares an intention to resign.
Her lawyers have argued it would have dire consequences if the court found in her favour in June. It would mean, they claim, that decisions and appointments made in the meanwhile may be invalidated.
