"The National Consumer Tribunal, the North Gauteng High Court, the SCA and now the Constitutional Court all agree with the NCR that a credit provider cannot legitimately expect consumers to pay NuPAY fees that are due and payable to NuPay Solutions (Pty) Ltd for the successful processing of loan repayments, in addition to the service fees that consumers pay to a credit provider" says Nomsa Motshegare, CEO at the NCR.
"Credit Providers can only charge consumers fees allowed and prescribed by the NCA. Any amount above or in addition to the prescribed fees is unlawful" adds Motshegare.
"The effect of the Constitutional Court judgment is that there will be retribution to consumers that have been overcharged, in that Barko must now refund them" concludes Motshegare.
